Course Description: The U.S. Centers for Medicare & Medicaid Services isn't known for easy-to-understand rules and regulations around Medicare. Unfortunately, that complexity can lead to misinformation, which can spread quickly. This webinar will debunk one of the most prevalent Medicare myths found on social media and in other venues. This webinar will provide information on the Jimmo v. Sebelius final settlement and clarify the rules to safeguard against unfair denials by Medicare contractors. The settlement agreement and the resulting revised manual provisions clarify that the Medicare program covers skilled care to maintain function or to prevent or slow decline or deterioration.

Speaker: Ellen R Strunk has worked in various roles and settings as both clinician and manager/director. Ellen is an expert at helping customers understand the CMS prospective payment systems in the skilled nursing facility and home health setting, as well as outpatient therapy billing for all provider types. She has years of experience in utilizing medical record reviews and data systems to help both inpatient and outpatient therapy providers meet regulatory guidelines as well as improve clinical outcomes. For the past ten years, Ellen has worked with dozens of clients as principal consultant and founder of Rehab Resources and Consulting, Inc. Her experience in both the home and community aspects of the post-acute care continuum gives her a unique perspective in finding solutions while ensuring a patient-centered approach is not lost in translation. In addition to assisting clients to meet their operational & clinical goals, Ellen lectures nationally on the topics of regulatory compliance in the post-acute care space and coding/billing/documentation to meet medical necessity guidelines and payer regulations, as well as clinically appropriate exercise for older adults, and the importance of functional outcomes to value-based payment.

Cindy Krafft PT, MS, HCS-O is an owner of Kornetti & Krafft Health Care Solutions based in Florida. She brings more than 25 years of home health expertise that ranges from direct patient care to operational / management issues as well as a passion for understanding regulations. Years spent in the direct patient environment solidified that this was the optimal setting for the provision of effective and efficient interdisciplinary care as it focuses on functionality and patient-centered care delivery. Recognition that providing care in the home environment presents both unique opportunities and challenges is clearly evident in both training and consultation activities. For the past 15 years, Cindy has been a nationally recognized educator in the areas of documentation, regulation, therapy utilization, and OASIS. She has and currently serves on multiple Technical Expert Panels with CMS Contractors working on clinical and payment reforms and bundled payment care initiatives. Her focus is on providing the knowledge and tools critical to the post-acute continuum of care to operationalize external requirements while keeping the driver of care where it needs to be – the needs of each patient being cared for. Cindy is an active member of the National Association of Home Care and Hospice (NAHC) and currently serves on multiple committees. 

Judith Stein is the Executive Director of the Center for Medicare Advocacy, which she founded in 1986. She has focused on the legal representation of older people since beginning her legal career in 1975. From 1977 until 1986, Ms. Stein was the Co-Director of Legal Assistance to Medicare Patients (LAMP) where she managed the first Medicare advocacy program in the country. She has extensive experience in developing and administering Medicare and related advocacy projects and conferences, representing Medicare beneficiaries, producing educational materials, teaching, and consulting. She has been lead or co-counsel in numerous federal class action and individual cases challenging improper Medicare policies and denials – including, Jimmo vs. Sebelius, which is opening doors to Medicare coverage and access to care for people with longer-term and chronic conditions. Ms. Stein is an editor and author of books and articles regarding Medicare including the Medicare Handbook (Wolters Kluwer Publishers, 20th Edition, 2019; updated annually). She is a past President and a Fellow of the National Academy of Elder Law Attorneys, a past Commissioner of the National Long Term Care Commission and the American Bar Association Commission on Law and Aging, an elected member of the National Academy of Social Insurance, and a recipient of the Health Care Financing Administration (now CMS) Beneficiary Services Certificate of Merit. She was a delegate to the 2015 and 2005 White House Conference on Aging, received the 2020 Excellence in Elder Law Award from the National Elder Law Foundation, the 2018 Chairman’s Award from the American Medical and Rehabilitation Providers Association, the 2017 Association of Retired Americans-CT Advocacy Award, the 2015 Grantmakers in Aging Diversity Award, and the 2007 CT Commission on Aging Age-wise Advocate Award. Ms. Stein is a member of the Executive Committee of the Connecticut Elder Action Network (CEAN). Ms. Stein graduated cum laude from Williams College and received her law degree with honors from Catholic University School of Law.
